just can't work out why they'd be selling espresso coffee hot enough to cause such serious damage!

im amazed that they found starbucks to be vicariously liable for the staff member! spilling coffee is hardly negligent... perhaps now they will only serve frappacinos in order to prevent such burns...? how hot would the coffee have to be to get a second degree burn? about 80degrees C?

Think of it this way, even if the starbucks coffee is scalding hot, it is still not going to compromise its flavour (assuming that there is any to start off with) ACG

Typical American and being a lawyer as well what a combo, Starbucks should compensate her with a life time supply of fungus coffee. With out any unbiased medical advice on her injury I seriously doubt the severity of her injury . The coffee would have to of been still boiling when it hit her.

i hate the blister on the roof of the mouth! didn't this happen to macca's a while back too? some lady got a coffee in the drivethrough, and spilt it on her lap. She sued macca's, and then they had to put 'caution: hot contents'warnings on the lids. that was before macca's espresso ... when it was all drip filter coffee.

Love the add the magic "caution" words and everthing will be allright line of thinking the idiots still have to read it. A bloke in america tried to lift his lawnmower while it was going to trim his hedges and wondered why his fingers got hurt, leading the lawn mower company to add another safety rule to its manuals so it wouldn't be sued. When is the legal system going to put a common sense filter on these type of cases ?

This is a very broad generalisation (which makes life so much easier) but I would venture to say that no warning or disclaimer anywhere was made to protect the consumer. Unfortunately, they only serve to [try] reduce litigation risk. In our documents, we have two page disclaimers basically saying all care and no responsibility. This is simply a result of a combination of crappy industry colleagues giving bad advice and stupid consumers who decide to try to sue because something didn't go their way. I think if someone drives with a cup of hot coffee in their lap and they spill and scald themselves and then decide to sue MacDonalds, they should be shot and put out of our misery (sorry for the excessive use of the word 'and' in that sentence). We have enough people on this planet and could therefore do with a culling of idiots (I should be careful then ;D) End rant P

this recently happened to a friend but it was the maccas espresso... just because water boils at 100 doesnt mean milk wont :p should have filed a case! hehe

erm actually guys (especially One-a-day ) the skin on the top of your feet is quiet thin and keep in mind that most people wear socks. socks being the absorbent little devils they are would draw any liquid spilt on them right to the skin and keep it there. my sister recently had a jug of burnt milk spilt on her foot and she most definitely sustained quiet a serious burn resulting in minor nerve damage. i dont doubt the seriousness of the injury and i know that a poorly trained EMO or one that just doesnt care could quiet easily over heat milk (im sure we have all experienced it) and even spill the drink as accidents do happen as far as suing goes.. If you don't have all the facts, then I guess you can't judge, but the Yanks seem to go overboard on this sort of stuff. What concerns me more is the quote by "P" about driving with hot coffee in your lap. This is a definite concern, because for us guys, if it spills, we may never father another child. ;D Don
